Fox 11 News Tonight...

Did anyone else just see that story? Allegedly, two kids (15,24) tried to break into this guys shed, where he grew mmj. He has barbed wire, keep out signs and bars everywhere... I guess he shot and killed one of the kids (The 15 year old) with a pellet gun! They arrested him on suspicion of murder, because one person said the kid was shot in the back. So the guy had to come out of his house to shoot him...

Either way, they kept emphasizing mmj. The homeowner has liver cancer. He was growing for mmj use... They didn't say if it was just personal or what.

Does anybody else think this is a super bad story and at super bad time for the community??

wow, he killed one of them! that must have been one of those old wooden one's. it must of hit his heart, that's too bad. it looks like he was trying to scare them not kill them. he shoulda got a dog. damn, bummer.

Interesting. I'm sorry I missed that. I'm not really sure what my opinion is here. It's hard for me since I come from a place (Texas) where what this man did is completely and entirely within the law. Shocked me when I moved to CA and learned you cant shoot someone who is in your home!!

If it were a legal medical grow then why didn't he call 911 immediately instead of getting out the bb gun?

I would have barricaded myself inside and called 911.

What people are not getting through their rock hard heads around here is that the community and media view medical cannabis differently than everything else and WE have to be prepared to act differently than we might normally act such if someone was there to steal our lawn mower or computer.

Are you sure? I thought it was legal to shoot someone in self defense if they were in your home.

California Penal Code, Section 198.5 "198.5. Any person using force intended or likely to cause death or great bodily injury within his or her residence shall be presumed to have held a reasonable fear of imminent peril of death or great bodily injury to self, family, or a member of the household when that force is used against another person, not a member of the family or household, who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence and the person using the force knew or had reason to believe that an unlawful and forcible entry occurred."

California Penal Code, Section 198.5 "199. The homicide appearing to be justifiable or excusable, the person indicted must, upon his trial, be fully acquitted and discharged."

TRANSLATION
197 - In California, the use of deadly force to protect oneself, someone else, ones property, ones place of dwelling.
198.5 - Using deadly force in ones home against an intruder is manifestly justifiable.
199 - Given 197 and 198.5, you will either be acquitted or the judge will immediately overturn the verdict.
Thank you for the translation!! The laws need to keep up with the changing language.

Haven't seen the story yet, but it appears the guy did not intend to kill this kid.....sad story.....and yes bad timing.

It sucks the Kid got Killed..This will be used against us I am sure.
BUT
The little Fucker was Trespassing with the intent of stealing Medicine from a Sick Patient.There is No Mistaking this (Signs, Barbed wire, etc..). (Same thing the DEA is doing under color of law.)
Why would You Barracade yourself inside..I personally use a .45 and a Jack Nicholson 3 Wood. That is after you escape the Chow and Shepard.
My Heart goes out to the Mother who lost her son, and the Father who lost his Namesake.. But, I have no sympathy for a Thief..

Wonder if it was one of those Nasty CO2 powered Bitches that are almost as powerful as a .25 or .22.

It is strange.. I have live briefly in other states.. And In Washington and Oregon.. You are a hreo if you shoot someone breaking into your home..
These were kids though which makes it diffrent.

There's an article in the L.A. Times about it this morning...apparently 24 yr old big brother has an arrest record for possession and dealing pot. I wonder if the story would have made the news if the robbers were after the guy's coin collection, or anything other than mmj...? Anyway you look at it, a sad situation for all involved, though, I too, have no sympathy for thieves, especially those that prey upon and steal from the old and/or infirm.

I have to agree with SR and KC2 - I have no compassion for thieves. I, of course, would NEVER have wished a child, or anyone, dead, but how come the news isnt focusing on this convicted drug dealer and his brother trying to steal medicine from a man so they can sell it on the black market? Sickening that they are blaming the victim.

And as for Texas, if someone is on your property, inside and out, and will not leave then you may shoot them. A guy I know in TX was shot in the head by his former lawyer when he would not leave his property. The lawyer was not even arrested much less charged. Texas allows you to protect your person and home.

But then again, I hate guns and havent ever even shot one.

However you look at this though, it is a sad story for all involved, including other patients.

Of course it would'nt have made the news. This is MMJ Baby the news is on it like flies on pies. Don't forget that the kid came at him with a weapon(hammer), and the kid does not have a sign on his head stating his status as a juvenille. 2 men broke in scaling fences and barbed wire, premeditated to steal from his property, and threatened him with a weapon.

So true. I hope this sick man doesnt have to die in prison for defending his most likely legally-owned property.

California Penal Code, Section 198.5 "198.5. Any person using force intended or likely to cause death or great bodily injury within his or her residence shall be presumed to have held a reasonable fear of imminent peril of death or great bodily injury to self, family, or a member of the household when that force is used against another person, not a member of the family or household, who unlawfully and forcibly enters or has unlawfully and forcibly entered the residence and the person using the force knew or had reason to believe that an unlawful and forcible entry occurred."

California Penal Code, Section 198.5 "199. The homicide appearing to be justifiable or excusable, the person indicted must, upon his trial, be fully acquitted and discharged."

TRANSLATION
197 - In California, the use of deadly force to protect oneself, someone else, ones property, ones place of dwelling.
198.5 - Using deadly force in ones home against an intruder is manifestly justifiable.
199 - Given 197 and 198.5, you will either be acquitted or the judge will immediately overturn the verdict.
LAST week ,almost identical situation ,Williams ,OR. ( so.OR ) ... 2 young men involved attempted theft from home-owner's property ... one shot ,both driven 2 secluded area 4 rendezvous w/ victim of attempted theft ( mmj plants ) ,friend .....
