Rep Power: 895 | Can someone help me! Last night at around 8:00 pm around 8 California highway patrol were knocking at my front door, I opened the door and they showed me a flyer with a picture of a guy that used to live in the rear house of the same property wich I live on,I informed them that it had been around 3 years since he moved to Mexico, They then proceeded to the rear house and began surrounding it , well my garage is attached to their house so they peeked in the window and got a little look,I saw from my window that they had started opening the garage door so I went out and thats when they began questioning me,they asked what was in the garage and I informed them that it was my medical garden, and that I had my proper paperwork posted on the walls and my originals inside my home,so they went inside and checked them out,one of the officers asked me the reason and told him and he began making smart comments about him having an ingrown toe nail and another claimed he had the same symptom as me,one officer high fived the one that made the discovery,One officer then asked me what made me think it was ok for me to do this I told him yes since I was a paatient and he then said so that makes it ok? I said yes its stated under law 215 under california law, well they left but one of them told me the sherrifs might still come by,so im really worried he said it looked like I was compliant so I shouldnt worry but that they still needed to check, and if not they wouldnt be leaving,im thinking of taking my grow down, should I or what does anyone advice me,should I contact a lawyer?someone please help,Ive heard san bernardino sherrifs still arrest you,and I live in Fontana CA...any advice is greatly appreciated, thank you |

Rep Power: 13401 | Re: Can someone help me! Sorry to hear the news. What a bummer! If I were you, I would hope for the best, but expect the worse. You may never hear any more about it, but then again... I probably would NOT break down my grow, but I would definitely do some damage control, just in case. Make sure the amount of medicine you have on hand appears reasonable for your medical needs and is within SB420 guidelines, if possible. Often growers end up having a lot of bulk plant material on hand. The stuff that is not good enough for smoking/vaporizing can still be used for cooking or concentrates, you know what I mean. This type of plant material can be weighed along with your buds, making the amount you have on hand appear suspicious. Do you have a scale? A box of Ziplocks in the kitchen? Anything that could be used to support dealing charges are typically collected during a search. Do you process your meds? If so, I wouldn't keep any bubble bags, or other processing equipment at your pad just now. If you own guns or other weapons, you may not want to have them around, either. It goes without saying, any type of contraband that you might have should be taken off site. If you were to be charged, you would be protected by California law, even if it ended up in court. I can imagine what you must be going though. Best of luck, and please keep us posted. |

Rep Power: 127208 | Re: Can someone help me! The Tracker posted good advice but I would not sweat it if I were you. The other LEO's are not likely to waste time on a small medical garden. But do go ahead and follow some of the advice, it's solid. |

However, things just don't seem quite as cool out in San Berdoo as it is here on the west side when it comes to MMJ. So, perhaps it's better safe than sorry. I've had a couple of visits (for non-related issues) where I'm certain my garden was noticed. (Not a word was said, either time.) Even though you are a qualified patient with a recommendation from a licensed physician and are following all applicable State and local laws, something like this can really raise your generally stress level for days (waitin' for that knock on the door). I found great comfort and solace in "cleaning house," so to speak. Just knowing for sure that you have all your ducks in a row, just in case, is very comforting. Should the worst materialize, the defense should be a slam-dunk! Probably most every one of us will fight for our rights, if it comes to that. This fight is clearly far from over. It's not my desire, but I would be willing to be a poster child for the MMJ movement, if charged with a crime for my medical cannabis use. A patient respectfully following the MMJ laws makes a much better impression on both the LEO's and our society at large. I try to not take our medical cannabis privilege for granted and never forget how grateful I am to legally use this lifesaving, life-enhancing flower. | |

Rep Power: 0 | If you are in SB county, you need to come out to the Board of Supervisors meeting tomorrow. They are putting a 45-day moratorium in place, and are going to craft a new medical marijuana ordinance. the kicker is that they want to do this with no input from us as patients. A group of patients and advocates are heading over tomorrow around 10:30 (385 N. Arrowhead Ave San Bernardino, CA 92415) to ask that a "Working Group" of County officials and constituents be formed. That way we have a good ordinance, one that we can all agree on, and hopefully one that will let you grow in peace, with no fear from the leos. Peace, Eowyn_Moriah |

Rep Power: 0 | Re: Can someone help me! All I can say to add is lockdown that room. Black the windows outs, lock things down. At worst it will avoid further issues once this one blows over. I would also lock all doors from the inside & make sure that you could only enter and exit through on door. And if you have the law laid out and you show them where it says you operate with in the letter of the law, they will not confiscate on a small op. I think it was Garden Grove that just got their ass handed to them for basically harrassing a patient. If they know the law and choose to disregard it, and you are clearly with in your "rights", they too will have major problems. Ask Escondido PD, they know all about these laws now too. |

Rep Power: 10261 | Re: Can someone help me! I see that this is kinda old now but, here's my two cents. If the cops already saw it, they have you if they want you. If you break down your garden, you could then be charged with crimes related to disposing of or tampering with evidence, etc. As long as you're within guidelines, have your information posted and DEFINITELY do not have any other contraband on site. Just keep to your business and secure that room better, it's presence is now known by people who are trained in picking locks and surreptitiously breaking and entering. Who also don't seem all that threatened or put off by it either. |

Rep Power: 0 | Re: Can someone help me! yes these guys are right keep doing what your doing. the cop was just trying to push your buttons. he was probably doing it to see how much you actually knew about the law. its good that you jumped to your own defense right off the bat so as not to look like an easy target. he could have probably taken the plants then and there as evidance anyway, it sucks how much grey area there is and that we have to operate within it. |
