Rep Power: 1788 | question about mmj laws so if 70 people, verifiable cali patients, all designate you as their caregiver, can you then flower 560 plants, and veg. 840 plants? just an example. this was a discussion i was having somewhere and didnt know the answer so i wanted so figure it out, those number were drew from what i thought were "guidlines" of 12 plants veg, 8 flowering. anyone will knowledge on this subject chip in, and give your take on the law. |

Rep Power: 10657 | Re: question about mmj laws No, because you can't simply designate a caregiver. They have to actually provide for health, housing or security etc not just provide MMJ. The text of law says so, people just haven't interpreted it that way. Jerry Brown has made it clear the letter of the law stands. |

In other words, you can form a co-op with several other patients, and collectively grow your own meds. All members of the co-op, however, must participate in the activities of the group as much as they are able (this assumes that some members are too ill to do much, while others are physically capable), and you cannot provide meds to any patient outside the group. (This is true of any legal dispensary as well). At that point, you would have to go by state and local guidlines (ex: Here in Santa Cruz City, you can have a 100 sq', or 10' X 10' canopy of mature plants per patient.), which vary. If you really have 70 patients who are looking to you, you should open a co-op yourself, or start a patients' collective. The state says each patient can have 6 mature plants. In theory, you could have that many (70) involved, but you would have to keep records, and it's a pain in the butt. Also, that many plants would require a LOT of room, water and light. Anything that large, LEOs would probably bust it first and ask questions later. Of course, things have changed, but discretion is always the better part of valor, and it is far easier to explain 12-18 plants than it is 36 or more, should the question arise. All it takes is for one neighbor to complain..... The big string to this is, of course, having the space (and if indoors, the gear) to do so. The other important feature is that the collective must be a closed loop-in other words, only meds grown by the group are used by the group, and no meds are obtained by the group from outside sources. This type of group is absolutely immune from any state or local action, since it is not a dispensary. Normally, membership in such a group is by invitation only, and reserved for seriously ill patients. However, if you want to start one, you might want to PM Happguy and ask his advice.
