All charges dropped

I just wanted to thank everyone who showed support in my time of need. I was called by an attorney who happened to be a family friend yesterday and was informed that my case and all felony charges were dropped! I can't even believe it. Another win for the MMJ community. Thanks again for all of your support.

Congratulations, Cheez,

What follows is important for all med mj users. My reasons here for emphasizing patient conduct (or misconduct) will become clear over the next month or two. You may assume (correctly) that I know a whole lot more about the law enforcement future of medical marijuana than you do.

If I recall, I told you, Cheez, that they would drop the charges. Now that you have had a taste of the criminal justice system, my advice to you and all other patients is simple. 1) Be careful and carry an absolute minimum of medicine outside your home; 2) do not distribute your medicine to anyone else EVER, even if you are in a social situation that would cause you to be accused of bogarting; 3) ALWAYS carry your medical marijuana physician's recommendation on your person along with good ID; 4) ALWAYS have at least a half dozen photocopies in various different locations, including leaving a copy with a friend, a parent, or a significant other who does not live with you, but who is regularly available should your lawyer need to get a copy. 5) ALWAYS have a current prescription or the cops will bust you, call your stash possession for sale, and charge you with a felony. So that call you have been putting off to your doctor is not a good idea.

I currently have a client who had 3 copies of his letter, one on his person, one in his car, and one in his home, and the cops seized all 3 letters. While this is fixable with a little attorney effort and some motions once a case is filed, counsel having a doctor's letter for his client BEFORE filing makes things a lot easier.

I cannot emphasize this strongly enough: you do not have a God-given right to smoke weed. The DEA and local law enforcement monitor Weedtracker every day. Screaming into the void about police interference with your "marijuana rights" simply will motivate them to alter your perception through the application of force. Frankly, they enjoy using force and they could care less about what you think.
There is no right to smoke weed in the US Constitution. There is no right to smoke weed in the California Constitution. There is what lawyers would consider to be a "license", i.e., a permission slip, that allows medical patients with a physician's recommendation (i.e., effectively a prescription) to use a limited amount of marijuana for the patient him/herself. Giving others marijuana violates the law, in the same sense that sharing one's Oxycontin prescription would result in a charge of selling an opiate (free is the same as selling), a charge that would definitely result in incarceration. The First Amendment's free exercise of religion does not include a religion in which marijuana smoking will be accepted by the courts, any more than Jehovah's Witnesses whose religion mandates that they refuse to allow their children to receive medically necessary blood transfusions will prevail in court when the child's life depends on receiving a transfusion.

The reason that I have written several paragraphs on Cheez's escape from the law is because I anticipate that things are going to get worse in the medical marijuana world, and they are going to get worse soon for reasons that I will shortly put into another posting here. Be smart, be careful and you won't have a problem.

Screaming into the void about police interference with your "marijuana rights" simply will motivate them to alter your perception through the application of force. There is no right to smoke weed in the US Constitution. There is no right to smoke weed in the California Constitution. There is what lawyers would consider to be a "license", i.e., a permission slip, that allows medical patients with a physician's recommendation (i.e., effectively a prescription) to use a limited amount of marijuana for the patient him/herself. Giving others marijuana violates the law, in the same sense that sharing one's Oxycontin prescription would result in a charge of selling an opiate (free is the same as selling), a charge that would definitely result in incarceration. The First Amendment's free exercise of religion does not include a religion in which marijuana smoking will be accepted by the courts, any more than Jehovah's Witnesses whose religion mandates that they refuse to allow their children to receive medically necessary blood transfusions will prevail in court when the child's life depends on receiving a transfusion.

The reason that I have written several paragraphs on Cheez's escape from the law is because I anticipate that things are going to get worse in the medical marijuana world, and they are going to get worse soon for reasons that I will shortly put into another posting here. Be smart, be careful and you won't have a problem.

When I have gone thru shit like this in the past, I have --tried-- to figure out what I "learned" in the experience...

cllindner made a great post about this, but I was wondering if YOU could boil all this down for us...

Knowing what you know now----after all is said and done------

What would you do differently, what do think was the "trigger" that started the whole ball of wax, basically --- how can we avoid the same thing happening to us?

If a LEO has a bug up his ass because the last guy he talked to was an asshole, or he has a toothache or his wife cut him off when she found out about his mistress----there isnt much we can do to help ourselves.... but if there are clear cut things you picked up in this experience that might divert the outcome---share them if you can.....

Again, glad this worked out the right way....there are way too many horror stories out there where it DOESNT work the way it should.
