I was stopped by a member of the Los Angeles Sheriffs Department, at 11.05pm last night Wednesday 14th Oct 2009.

When he approached my car and asked me for license registration and proof of insurance, I duly gave this information over. And politely asked the officer why I had been stopped?

He replied you were seen exiting a well know weed store on Ventura Blvd.

He went back to his car and ran my details and came back after about 10minutes, and asked me to exit the car and I asked him why, he just said get out of the car,

I got out of the car and locked my doors as I exited.

He started to pat me down and I asked what he was looking for on my person, weapons and your weed!

He said he felt something in my pockets and started to search my pockets to which I said excuse me officer I have not at any point during this stop gave or even hinted that I would allow you to search me.

He just went ahead anyway and after pulling out my wallet and keys along with change put it on his car hood. Then asked my to put my hands behind my back.

I asked him if I was being detained or arrested , he replied you are being arrested .I asked him under what charge or penal code and reminded him yet again that I do not or will not consent to a search.

I was handcuffed and placed in the back of his car. He went to my car and tried to open my car door to search my car and found it was locked. He asked me to open the car and I said no I am not consenting to a search of my car and also did not consent to a search of my person as you officer have broken my constitutional rights under the fourth amendment and as such will be reported to your superior and my lawyer will be in touch to file charges for false arrest and detainment against my civil rights having been already informed that I will not consent to a search.

He said either open the doors or I will call a K9 unit. I said call the K9 unit.

We waited for approx 45mins until a K9 unit arrived and they got the dog to externally search my car and the dog did not pick up any scents. And the unit left.

At this point I was decuffed and told I was free to go, I then asked the officer for his badge number and name to which he said I do not have to give you that information.

I reminded him that he had already broken my constitutional rights by searching me against my will and expressly reminded him that I said at least 4 times that I would not consent, and If he wished to refuse to give me his information, I would add that to the formal complaint I was filing with his superior and my lawyer.

He said you can leave and I has better leave now or???.

I replied OR what officer ?

He said just leave or it will only get more painful for you. At that point I call 911 and reported that I was being attacked by an unknown man at this location. And gave 911 the description of the unknown man .. A police car arrived less than 2 minutes later at my location and asked me what had happened , I informed him that I was falsely detained and handcuffed by the officer next to him.

The cop laughed and said you’re reporting that you were being attacked by a cop.??

I said yes I asked the officer for his badge number and name and he refused to identify himself and then started to verbally threaten my with violence unless I left.

I filed a police report and got a copy of that report and filed both reports with the officer in command at the nearest police station and gave copies to my lawyer as well.

PS. They tried to get me to change my mind at the police station and I reminded them that not only was I falsely arrested and detained against my will that the officer also violated many constitutional laws and rights and as such will be reported .

1am this morning Thursday 15th Oct I departed the police station with a clear conscience, and a load of papers for my collection.

Maybe I got lucky this time but maybe if you do nothing illegal and know your rights you will be safe,

You got my respect!!! Way to go Ref! That butthole might think twice about manufacturing probable cause, it sure is not a crime to go to a co-op. That POS wasted an hour of law enforcement on you, while muggers and drunk drivers enjoyed free reign.

he might as well start searcing every car that leaves a liquor store for an open container and issue people FST for for same if hes puilling people over coming out of weed shops.whats sad is that he would have given you a hassle if you did not have the state card if he had found your weed and possibly a FST yet he knows full well the shop had to verify you to let you in and you are legal.

falls under catagory of wasting everyones time and harrasing medical patients

Nice! Very nice! Just sad that you had to go through that in the first place. There was a collective in Gardena that had a similar problem with the sherriffs pulling patients over for simply pulling out of the parking lot of the collective.

that was a real good move locking your car. he was going to take your herb and probobly give you a ticket. i once got a ticket in glendale for possesion of marijuana. cost me $541 (i didnt have my rec. yet)

Has anyone gathered enough of these instances, with documentation to show a pattern of harrassment?

Have you talked with the Dispensary's owners to see if other patients have had the same experience?

Have you talked to the ASA? This sounds like with enough documented instances this could be used as the basis of a harassment suit, perhaps class action if enough are invovled.
