Ms. Bennett, a resident of Los Angeles, was in San Bernardino Co. on a family matter when SB authorities sited federal law over state law as they removed the 3 month-old from her breast and arrested her. She was charged with public intoxication and possession. At this time, Ms. Bennett does not know where her infant is and calls to CPS and Co. officials remain unanswered, as today is an “unholy”day. This Thursday, Ms. Bennett has a hearing before San Bernardino Juvenile Court at 8 a.m. I urge you to attend. (For clarity - Ms. Bennett is not a juvenile.) I look forward to seeing you there. If you are leaving from the LA area, please feel free to contact me about carpooling. When: Thursday, October 11, 2007 – 8 a.m. Where: San Bernardino Juvenile Court, 860 E. Gilbert Street, San Bernardino, CA 92415 Why: We must let authorities know that taking our children is not acceptable. I plan to attend the patients rights ralley in L.A. this day, but if I can manage to squeze both in I will be there. Some here in the inland empire are planning to speak at the Oct, 23rd San Bernardino supervisors meeting re: mmj and s.b.co. traitorious positions, I would encourage you to have her attend at share her nightmare of terror experienced at the hands of these tyrants. I was in a foster home for 16 months till my father had his court case acquitted. This is not right for the kids or the parents going one second without your family is absolutely not right, this should be put back onto the police or DEA or who ever does this. How would Officer dumb dumb feel about coming home to his kids and there gone, and now he has to go to court for eating donuts and drinking coffee, knowing there kid is hanging out in a foster ward of half way house with kids that do drugs or steal or even hurt other kids. NOT COOL WE NEED TO DO SOMETHING ABOUT THIS. GO SUPPORT THIS WOMEN CAUSE RIGHT NOW SHE NEEDS ALL THE SUPPORT THAT SHE CAN GET. |

I am confused about the SB authorities "citing federal law over state law". If they were indeed SB authorities they would only be allowed to bring state charges, not federal ones. I think their kids should be taken away from all of them. In fact lets take all the kids away from cops and see how they like it. I am sure they wouldn't!!! I don't think cops today are fit to be parents. Think of how often you see a cop do little stupid things that are blatantly illeagal? Whether its turning without a signal, completely blowing a stop sign, or arresting an MMJ patient. It doesn't matter what they have done, they are breaking the laws they are paid to uphold. If any of us ever did our jobs as poorly as cops we would all be unemployed. We need to hold ALL government officials responsible for these actions, and they should ALL pay the price. |

(normally a dangerous thing) CPS must by State law investigate ALL reports of abuse or neglect made to them. Clearly there is an abuse of authority going on here but it has crossed into abuse of this family and of this child. Here are my thoughts. We could make calls to LA's CPS office and make complaints about the San Bernardino CPS and the circumstances of this child's abduction. They will be forced by State law to at least investigate. Option two is to call and contact the CA Department of Social Services, Children Services Operations Bureau. This is the CA State agency responsible for oversight of the County CPS. Third choice is to try and inundate the San Bernardino CPS with complaints. Which is the option most likely to result in success? I hope all of you do the same. This is just fucked up to have her child taken from her for having weed which she is legaly able to have. |

It is pretty rare that a child is reuntited prior to a court hearing. I called, the California Department of Social Services, Children's Services Operations Bureau today and they were already aware of the case we were concerned about and investigating it. I called the San Bernardino CPS and they were exasperated by the number of calls coming in. Good job one and all! This may be a template for similar circumstances in the future. If we keep the pressure on the State Dept. of Social Services they may issue new rules regarding MMJ and child welfare, avoiding this going forward. |

Rep Power: 15 | Re: This weekend yet another child was taken from her mother, medical cannabis Family court will look dimly I believe on this poor mother only because some of the THC is fed to the infant at breatfeeding and the quantities or related damages are varied. Mother's who have to take nacotic pain relievers would be passing on some of the drug to the baby as well and there does not appear to be any comprehensive studies I've found suggesting all the ramifications of MMJ & breatfeeding. In the end she will get her infant back because I worked Neonatal Intensive Care for 23 years and family courts end up releasing alot of these babies right back to their parents if some responsible behavior is demonstrated. |
