...before I started consuming mmj, my landlord tried to cause me to move because I asked him to do necessary repairs, supervise his building, and make reasonable accommodations for my health conditions. This is illegal and known as a constructive and retaliatory eviction. When my landlord failed to cause me to move, he conspired with corrupt government workers to evict me based on "unlawful use of marijuana" but my use of medical marijuana is lawful. I have substantial evidence to prove my claims. The state did just conduct a trial against my landlord for discrimination, harassment, and oppression. However, that decision has not been handed down and is not expected until August! So, I need my community's support as I have until June 2nd, 2009 to either abandon our rights and become homeless or I have to contest this eviction now, today, tomorrow, Monday. But, I cannot do it alone. There is a lot to do in a very short period of time and these corrupt people need to know there is a community presence involved and that they will be held accountable for their corruption!

I have no time to prepare to move while I am preparing an accusation to be presented to the City, County, State, and Federal Attorneys that will stop the eviction. This is overwhelming me and they are relying upon me becoming overwhelmed and ineffective.

Today, I have to finish writing the accusation against the landlord and the government that I will present to the City Attorney, the District Attorney, the State Attorney, the US Attorney, and President Obama, if possible, tomorrow, Friday May 29th, 2009!

So, I need the presence of responsible mmj patients while physically presenting this accusation to them in their offices while getting prepared for a possible act of oppression in the form of a wrongful eviction due to my successful and lawful use of medical marijuana!

Particularly, I need help getting this place tidied up and I need help preparing my home for an actual physical eviction, that is, deputies will show up at my door to physically remove me from my home despite my lawful tenancy and successful consumption of medical marijuana under the supervision of my doctors and in the privacy of my own home (no growing or parties involved, just my quiet good faith and lawful tenancy)! I need witnesses and someone to video tape the oppression if it occurs.

An eviction means the corruption involved in mmj laws is so pervasive that our government has failed to enforce the mmj laws and they are using systemic corruption to literally strip me of all my rights to cause me to become homeless, and my becoming homeless will put my life in immediate peril with no hope of survival due to my medical conditions, and this oppression needs to be documented on video tape and distributed to the community, the media and other government agencies that may be able to help us get the mmj laws enforced if there is any justice left in the system...or is..."there just us in the system" and we are no better off today than our fore fathers were who left oppressors elsewhere and founded America!

So...again, the help needed is in the form of people who can help me do all the tasks necessary to either prepare to put my stuff in storage and get this place cleaned out and video tape the oppression if it occurs, while others protest the oppression before and while it occurs, while others help us finish and present the accusations and evidence and law to the community, media, and government to compel them to do their jobs and enforce the mmj laws and protect my and our rights.

I'll need today to be by myself to finish doing the accusation.

Tomorrow morning, I need an army of responsible mmj patient and caregiver activists to get directly involved in my home to protect our rights and stop the oppression by protesting and assisting me in delivering documents and getting this place ready to have a video tape done during the actual time the sheriff shows up to strip me of all of my civil rights and make me homeless for responsibly and successfully consuming marijuana as a medicine within the privacy of my own home if this occurs.

I believe we can do this! The law and Obama's campaign promises are that supposed to be "American policy" are clearly on our side and protect our rights! The government has no more excuses left at this juncture! It is time for mmj community action to achieve justice to get mmj laws enforced!

This is a wonderful opportunity for us to show the entire country the injustices and harassment we responsible mmj patients have suffered and are suffering at the hand of corrupt government because corrupt government continually fails to uphold the mmj laws and they continually try to oppress us!

It's 7:57 PM and I have not received a return call from the city attorney despite an in-depth meeting with the assistant city attorney last month and despite two urgent calls to his secretary and two messages to his voice mail in the past 48-hours. Unfortunately, and as was the case when I originally asked the city to do their jobs and they failed to do their jobs, it is clear the corruption extends not only to the superior courts, but also the city attorney's office. I will absolutely need witnesses when I drop of my formal accusation to stop the eviction tomorrow at both the city attorney's office and the DA's office. Then, we have to find the local state and federal offices to get these complaints to the state attorney general, the US attorney general, President brother, who lost his cool, Obama! He needs to step up and enforce states rights and the medical marijuana laws as he promised to do during his campaign and as the US Attorney General stated he would do as President Obama's campaign promises "are now American policy" and this American policy protects me and us in this exact situation!

I am wondering why you did not file an appeal of the detainer when you received the notice of eviction? You have five days by California law once you receive it.
Once you file an appeal, you are automatically granted a 20 day stay from eviction. You will get a court date during that 20 day period and you cannot be evicted till your case is heard.

Your case as you present it seems to be unusual. Have you contacted a local free legal right organization? They can help you with this.

I was too ill to engage in any appeal at the time. But, more importantly, the judge ruled on the law and the decision is not appealable when the judge rules on the law. However, since the court ruled in error and the error is so glaring, the decision equates judicial improprieties, and this can be addressed via a Bane Act violation proceeding first, and then a judicial complaint as soon as I have the time. I am working on preparing the Bane Act violation today and this is one of the tasks I need community support with tomorrow, getting it delivered to all government agencies!

Bad morning everybody!

My caregiver flaked on me 3 nights in a row and I have been unable to get the right meds for good rest during this extremely critical period where I need to focus on complex legal documents and keep on track with possibly packing and putting my stuff in storage.

...if I can't find any help getting this place cleaned up and if I can't find help putting my stuff into storage, I will have to sell all my personal items and be left with nothing if I am put out on the curb -- no rights, no law, no community, no nothing.

If you are interested in helping, please let me know right away.

At the end of today if there is no help, I'll be on the street tomorrow selling my stuff for whatever I can get for it and praying for a miracle after working so hard to move our rights forward and after I have experienced such great success with medical marijuana in the face of extreme adversities.

Also, I am not going to be able to contact any government agencies to today to get help because I haven't slept well enough to do well in the situation.

So...next Monday, cutting it close, but I've got no other choice. After I sell my stuff, I'll go get meds and be ready for Monday!

Man, if I have to do this alone, I will be pissed!

"It is possible, but rare, for a losing tenant to convince the court to allow the tenant to remain in the rental unit. This is called relief from forfeiture of the tenancy. The tenant must convince the court of two things in order to obtain relief from forfeiture: that the eviction would cause the tenant severe hardship, and that the tenant is able to pay all of the rent that is due or that the tenant will fully comply with the lease or rental agreement."

The landlord conspired with HUD to terminate my housing assistance, so I have no means whatsoever of guaranteeing rent until I get my wrongfully terminated HUD voucher back. So, I cannot file an appeal under any circumstance!

Again, the only option I have is to get Bane Act violations filed and then seek to have the judge removed for improprieties after everything else resolved, getting a judge removed for improprieties is quite an undertaking I can't let that interfere with that I need to accomplish over the next few days. I've got his name, we'll kick into legal action against him later.

...another legal action added to this mountainous pile of illegal actions.

Wow! Thank you! I'm in Thousand Oaks, so we're close!

Fortunately, this is a small apartment. And, there is not much to pack and no heavy furniture to move. Other than vacuuming, which I can do myself, no other house cleaning is needed, so it will be an easy pack and move, if necessary! I just need help getting the stuff boxed up and I need help moving two beds into storage on Tuesday, early, we'll know by Monday night, Tuesday morning if the government is going to oppress me, if that is the case, break out the camera and we'll be ready for them!

I don't own transportation, so if you have or know somebody who has a pickup, that would be helpful.

I need a few persons to go with me on Monday to see the City Attorney, the DA, and then find the local state and federal offices.

Also, all the stress is making me really, really nauseas and I heaved a few times i the past day and I am out of meds and can't leave to go get meds. If anybody wants to help, HELP! Somehow or another, I need to get a good rest tonight or my symptoms will start getting worse and I will be useless!

We can do the actual move on Tuesday before 6:01 PM, if necessary (forever the eternal optimist here).

I get my SSI payment on Monday, till then, this process has broke me...and I'm working on will and karma and a prayer and hope -- no food, no meds, no nothing! So, any help would be appreciated.
