Anybody have any experience with a Motion to Return Property with the Los Angeles Sheriffs department? I have a possession court date on the 18th at the Compton Court House for under an Oz of MMJ & am curious to know if anybody had any success dealing with the Compton Court House & also getting their meds returned by the Sheriffs.

I was arrested by the Carson Sheriffs Department for a bench warrant in 2002 that I had mistakenly forgotten about but had not appeared on my DMV 5 yr record. The funny thing about it is that I have a valid Drivers license & they still arrested me quickly. After they started to search my car I began yelling, "I do not consent to a search" but I was later told that if I have a Bench warrant then they can legally search my car... However, my car did not smell like marijuana nor was I medicating but he still decided to confiscate all my Meds that I had just purchased for the rest of the month. Even after mentioning that I am a valid MMJ patient the Frickin Pigs never even gave me the opportunity to show any of my paperwork or ID's... I was cuffed the whole time & they were ignoring me when I was indicating were they could find all my papaerwork...

The thing that pissed me off the most is that I was just parked at a park just like everyone else there enjoying the shade & waiting for my Girl to get out of her interview when they singled me out & ran my plates. I was not medicating or doing anything wrong just parked listening to some Tom Lykis on 97.1 FM enjoying the shade like many people were doing there while my girl got out of her interview.

They began to prowl & Prey as most LEO's do & once they ran my plates they immediately pulled me out the vehicle, put the cuffs on me & searched my car even after stating to them that I can show them my recently renewed DL & was not aware of a warrent...

They eventually started searching my car & found my Medication Bag & started to open my Med bottles & smelling them all while smiling & nodding his head as if he was saying "this is some good shit"..... He than began to collect them & put them in his evidence bag...

I was soooo pissed off they were harassing me.. To top it off at that same park just a few cars down they had some rapper guys taking video footage of some Ghetto ass stripper girls showing off their fat ass' & coochies all over the cars... Yes, Tops only & no thongs on etc.... I waited there with them in the back seat while they laughed & had a good time all while talking & flirting with the Strippers, and later mentioning to them that they needed to wrap it up... FRICKIN PIGS!!! There were Kids at the park just the other side of were they were at and obviously they didn't seem to care..... Frickin Ridiculous!!!!

Anyways, I have already downloaded all the FORMS on ASA's website & am confident I have a good case in getting the charges dropped & Dismissed by the DA but I am curious about the Sheriffs response in me requesting my meds back... I was wondering if I should try before my court date & if they deny me then I would mention that I would be filing a Motion to return my property.....????

What do you guys think??? Any advice is helpfull...

first you need to fight the possesion ticket before you go for a return of property.

I have dealt with this at the malibu courthouse. There you can fight the posesion, bring all medical documents from non MMJ doc as well to back your medical claim. After you win your case you file for a return of property and if you are lucky you may get your meds back.

The courthouse you go to shouldn't matter in the least, since they all have to follow the law. Since you are a legal MMJ user, I doubt anything will happen other then having the case tossed out. This is what happened to a relative that was charged with possession and a legal MMJ user.

The cop was just doing his job.
As for the rapper, it sounds like you haven't left the school yard, "go bust Billy he is being bad too!"
Bottom line is the only one you should be mad at is yourself, you are the one that got the warrent.

It bit me in the ass, Tickets never go away... As for the school yard thing, I wasn't expressing that to the cops man, I was just thinking, these guys could of let me off the hook just like he did these girls who could of been arrested for exposing themselves at a park in front of children.. The ASS was out there all over the place man, all over the place....

I know he had the right to take me warrant is just that, a "Bring him to me". But, my plates were clean & I had a Valid Drivers License, Registration, Insurance etc & a recent 5 year DMV Print out. He could of been a nice guy & asked me if I was aware of a warrant & then told me that I needed to take care of it ASAP and let me go... I don't want trouble with the Law Man so I would of token care of it that very next day..

I do feel like I was singled out though here's why: There were at least 5 other people parked in cars enjoying the shade. I seen them pass once & like a gentlemen I knotted hello all while they were mad dogging me & as soon as they passed my car. He then reversed & pulled behind me & then ran a deep search on my plates etc.. I honestly felt they were prowling & preying instead of protecting & serving.. I was never read my rights & never was allowed to show any of my documents or ID's.....Some cops make the judgment call right then and there...Guilty until proven Innocent...

Bottom line is your right. I should of taken care of it then. But now I have:

Time Served!

Hey, better then than in a worse situation in my life, I guess...

just make a motion to dismissbased on the fact you are a medical marijuana patient and show youre(original medical recomendation to the baliff to be submitted as evidence.if they give you some crap about the validity of youre medical note ask that the court to
verifiy within thirty days or dismiss the charges.
