Well, I guess its my turn in the Barrel..
I posted this on the 11th of June....
Pomona Police just left my house and confiscated my entire garden including my lamps...
I was told that because my plants are in plain view.. They did not need any warrant because I was in violation of Federal Law for Cultivating Marijuana and my plants are in plain view... You would have to go all the way to the back of my house by driveway, and look over the fence to see anything...
I believe it was the Pomona Police come to call after flying that damned Helicopter over my house two weeks ago....
Some how I am still here to write this?? They are gone now... They were here for about forty five minutes or so...I guess I was convincing enough but it was kept to a Complaint and I was not arrested right then...The D.A. may still have charges filed at a later time.
My wife is in contact with a lawyer, and when I speak with him tomorrow... I will have a better idea on what to do next...
At least they left me my Medication in the Dispensary bottles and my vaporizer... SO, I think I am going to medicate right now and just try to calm down..

That sucks. I highly recommend getting the california state card if and when it is available in pomona. They cannot confiscate anything, unless they have probable cause to believe that fraud is involved, or you have guns, large sums of cash, or illegal narcotics.

I don't understand how can a helicopter see your indoor grow? I was Marine helicopter crew chief back in the day. Lot of looking for things from a helicopter never saw houseplants. Even if they saw them that view is not plain.

In my case the Pomona P.D. Copter circled my house in late afternoon on Sunday 5/10/09..
I was out mowing my back lawn just next to my OUTDOOR Garden... They circled very low. around 3 to 400ft. in a very tight circle for twenty minutes or more...They absolutely spotted my Plants..My wife got so mad she went outside and flipped them a double bird and the flew away right then... one month and a day later... Here they come to arrest me for felony Cultivation....... My Paper work was as good as Butt wipe to them..... They even told me that my paper didn't even have a look to it that they could respect....
They Took Six plant from my yard that were in flower and five under lamps in my Garage...Took my expensive lamp setup to.... Now my wife has her Rec. too but that did not concern the Police at all...

I understand now you had in and out door grow. I don't know how many you are allowed by the city or county. But they f**ked you. The State gives you the right. Keep us posted hopefully someone will come forward to help you legally. I had a LAPD bird circle and appeard to watch me water my crop just two days ago.

Pretty sure they need to be in a locked greenhouse... What if the soccer moms kid jumps the fence, rips your plants, goes and gets high or tries to sell it and gets caught...
That's only one scenario as to why they need to be in a secured environment.

I'm a lawyer. How many plaint did you have growing? Did you have your doctors recommenation posted by the plants. Under Prop 215 local police cannot enforce Federal Law. You are allowed to grow 6 Mature plaints and 12 immature plants such as clones.

Who ever came up with this idea that posting your rec in your garden would keep you out of jail is very SUBJECTIVE.

Yes, It's nice, but unless police agencies set policy where there are very specific rules to go by, this is just another policy that don't mean shit to Leoz.

To suggest that this person had his grow confiscated because he didn't post his rec in his garden is way off. We all know that his rec alone should have sufficed.

If they would have knocked on his door, inquired about his situation, & then led a discussion on better/proper garden maintenance would have sufficed as well.:blush:

My Wife and I are Middle aged Disabled MMJ Patient with our Recommendations on us at all times and Recs with the Garden on my property... Poster Children of what Legal was supposed to be until the Pomona Police came and said I was going to be arrested for Felony Cultivation. To open my Gate or they would have someone do it for me... I gave up my garage so they would leave my house and wife alone....

You are not addressing your violation of the law..
You grew outside without a locked greenhouse.
That's the only reason you got busted.
Now... The police did what they WANTED.. They are probably aware that you will get to court and have your case dismissed. It caused you alot of time and money and is going to be quite the headache. Probably their plan..
I wonder if it has anything to do with you guys flipping the bird at an officer just doing his job? He didn't know who or what you were but as soon as you gave him the bird I imagine it gave a lasting impression.
I think the lesson you are being taught is your are not invincible from the law, your use and prescription for MMJ does not give you the right to do whatever you want..
You call yourself a "model" patient but you grew in violation of the law and you disrespected a police officer doing his job.. So I question your ideals of what a "model" MMJ patient is..
You are safe on your plant limits, they could get evil on you arse if they wanted about the outdoor plants but I suspect ou will get your grow lights back and your case dismissed.
Next time try using some tact and then maybe this will not happen again?

Folks are getting more and more laxed, yet LEO is in a head spin trying to dechiper from 30 different bosses how to enforce it..
If I come across like a LEO, it's only because I try and put myself in their shoes... I am good at playing devils advocate.

I do not believe he is an area that has enacted laws that require the outdoor grow to be locked up or in a greenhouse, where is this law that you are so sure of that you would have confidence to make these statements you made about his violations. Yes, some backwards cities and counties like San Diego may require this but he is in Los Angeles County and no such requirement exists as far as I know. Please inform all of us of this law that you know of.

It's been in effect since forever......
"No cultivation of medical marijuana shall be visible with the naked
eye from any public or other private property. No outdoor cultivation shall occur
at a location unless it is secured from public access by means of a locked gate

If you are worried about plant numbers refer to the Keely and Phomphakdy case.
The state DA has conceded that plant limits are unconstitutional.

If felony cultivation is the only charge then I feel very confident in saying your case will be dropped asap.
I can only hope that this made everyone think twice about how invincible they think they may be..
Growing outside poses many risks and you just encountered one..

What do you not understand about jurisdiction, nothing in the City of Los Angeles Interim control Ordinance has anything to do with anything outside of a dispensary in the City of Los Angeles. Please refer to some law, any law that could be interpreted to cause any reasonable individual to know with certainty that it is illegal to have plants in your own backyard in Pomona.
Just like the law in San Diego can not be enforced in Pomona, the law in the city of Los Angeles can not be enforced in Pomona.

Just like the law in San Diego can not be enforced in Pomona, the law in the city of Los Angeles can not be enforced in Pomona.

Yes my mistake. I have always been under the impression it was state wide.

i. No outdoor marijuana cultivation shall be permitted. Growing marijuana shall only be permitted in a fully enclosed greenhouse or structure that must be locked and contained. The amount of marijuana grown in the enclosed greenhouse or structures that are locked and contained will be limited by the indoor plant guidelines.
