I was cited at my smoke shop in the raids in December of last year. I was cited with selling narcotics paraphernalia, which is bullshit because in the discovery, the undercover officer only mentions "stems and seeds" in reference to needing a quality grinder. He made no mention of illegal substances, and as any sane human being knows, ALL PLANTS HAVE STEMS AND SEEDS including salvia, spice gold, legal buds, etc. etc.

Guess what, my attorney is negotiating them dropping my charge to a simple possession of drug paraphernalia (at no point in the UC transaction was an illegal substance mentioned or named, it says that three times in three separate police reports), which I think is preposterous. There should be a total DISMISSAL of all charges relating to my case. Not only that, a judge recently threw out the search warrant of the raid of our store and released all confiscated and purported "drug paraphernalia" back to our store. How could I have possibly sold drug paraphernalia?

Anyhow, I don't want to bow down to this fucking BULLSHIT, but if i have to cop to the lesser charge, I will be eligible for PC 1000.

Now my question: I've been a legitimate MMJ patient for about 5 years; PC1000 requires a drug screen. Will I be able to use my MMJ patient status and continue using my medicine like i have?

Please give me all information you can. I don't know how to handle this situation and I feel like my attorney isn't doing what he can for me at this point.

I'm on probation and I know I have to go before my judge and get specific exemption for mmj, but supposedly they have no right to deny us the use if we have our doctors recommendation prior to whatever mess you get in. If you have a lawyer ask them or ask your judge.

You should of made mmj exempt, when u signed your deal. Now you will have to go back before the judge, and get a modification to your existing order. Also, I would'nt try and settle the matter with probation. Only a judge can modify a court order. Your in San Diego, county of political garbage, lies, and taxpayer wasted money. If you go back to smoking and turn in a dirty test, without a judges singed order you'll probally get violated. When it comes to polotics these things happen. Had a friend that got violated on his last day, because he had left the state, for buisness reasons, with permision from his probation officer, but because he would'nt be a rat, on another issue the judge said the court never gave permission and gave him 2 years, that he actually served. My advice is to consult an attorney. I've met a few people, that have won.

I had no Idea that Program still exists...
Back in 1977.. I was stopped and a oz was found on me... This is California.. We just changed the penalties for possession of under an oz.,, A ticket and $100 fine..
I was ok except the pipe.. It was clean and never used, but they charged me with possession of drug paraphernalia... And So the judge let me go as long as I completed 12 weeks in the PC1000 diversion Program..

PC 1000 is created for people to fail and be in the system the rest of their life. Don't risk smoking until you get explicit permission to do so, because theyll slap u with violations, fail you from the program, and transfer you to drug court.
