parole and mmj

um kay and so my friend has been in a really bad car accident almost lost his leg up to his knee. they had to take the muscles out of his stomache to form his leg over again and tons of pins, since it had been tore off.

anyways he's on parole and the reason is not drug related.

he's on all kinds of pain meds now just trying to get through the day.
the bad thing is he's totally addicted to these meds now and won't do anything without them.
he 's not eating either because of the pain medicine, so all he has is a vitamin water and wings it the rest of the day.

he wants to get his rec and completely get off the meds.

will or can his parole officer send him back to prison for a violation on his drug test.

Re: parole and mmj

according to state law a person on parole can get an exemption for MMJ but it must come from the judge. So your friend would need to see the judge to get them to give him an exemption.

exactly, the worst a judge can do is say no, I would also print out the section of SB420 that covers this section and have your buddy use this as reference also.

Re: parole and mmj

Well I have had the pleasure to experience state parole in Calif. and Federal probation in Calif. The feds were way worse for drug testing, I got 1 dirty and back I went. First to the state for abscounding 5months violation, and then back to the feds, cause they put a hold on me when the state nabbed me, and I had to go back to the drug program I got kicked out of, cause of the dirty. Any way I was another 5 months in M.D.C. (fed holding in L.A.) wating to see what the fed judge is going to give me and it was the 5 months I served in Feds and back to compleat the drug program. So my long winded point is the state don't really trip on mmj at least in my exp. Its the hard drugs they will violate you for, and depends a lot on your repor with your P.O. cause some are pretty cool but watch it cause some arn't cool at all . Talk to your P.O. and see what he/she says, so thats it I guess just see what the P.O. thinks about mmj, most don't care in the state anyway, the feds will vilolte you for mmj real quick, so good luck .... And oh yea the pain relievers your friend needs, tell em to check out a methadone clinic thet's what I use and I havent been busted for anything in the last couple years or on parole either and dont intend to !!! peace

Re: parole and mmj

I have been on parole as well out of Santa Ana and never had an issue, but it was not my controlling case and I never had a dirty. Plus Parole DOES NOT test for marijuana unless your controlling case was for it. I had 2 different agents and did my thing and never gave them hassle and they never did me. I had to show him the law when I first paroled, eight years ago now! Never been back, parole is way more mellow than probation except from a cops point of view, they will treat you like a piece of shit and is no fun. Especially if for drugs since most everyone has used, just some got caught, why are they worse?

I have dealt with parolees while working as a social worker at an out patient drug rehab.

They use to tell me, and please don't take this to the bank and risk your freedom on my word, but the Fed P test really didn't screen for marijuana.

Could be a couple reasons, the first that comes to mind is $$$ because I believe it's a different screen and more expensive. The second could be that that's the least of their (the Feds) worries.

Keep in mind it's been about 10 years since I was doing this so things could change but that's the way I remember our conversations going.

much love
