Your card/rec should protect you in your court proceedings if you follow their advice. Unfortunately it doesn't always stop police officers from writing tickets.

| Re: legal advice please! What "mmj card" did you show them? You mentioned you are in LA County... A suggestion when it's all over: NEVER GIVE UP YOUR RIGHTS! DON'T SUBMIT TO A SEARCH THAT THE LAW ISN'T ENTITLED TO. Most of all: If you are a patient, take the ASA training! It's an hour of your life you won't regret...and you will know when to submit and when to decline the search. One more thing.....use the trunk! It's your best friend :) Take care, DU |

I can just imagine showing an leo one of those old Fairfax cards, especially if the cop is already leery because he saw you do something strange while driving, and did not see what caused you to do it. Add in even the slightest hint of 'tude (even if you didn't have one, he might PERCIEVE of one), and you have a recipe for, if not disaster, then at least a royal pain in the butt. You didn't mention where your card was from. Some forms might not be recognized in this area, since up north they have the state id card while we down here are still waiting. You should call the Dr. who wrote the rec right away. Peace, damudbug

Rep Power: 22112 | Re: legal advice please! I too was stopped by the LA County Sherriff. I was issued a "possession" ticket and was told to appear before the court. The cops use the excuse of "possession" to make your life hell and to cost you $$$$. I contacted attorney Allision Margolin, who explained to me my options. Having a MMJ card and verifyable recommedation is only part of the plan to get the charges dropped. (Having a misdomeanor means having it on your record for three years). We went to court, and the case was dismissed, and I now have a clean record again, thanks to Allison. They did not return my medicine. Cops-- stop acting like criminals. Stop taunting patients with "bad munchie jokes". This is medicine, stupid. Who would taunt someone with MS or other illnesses? The Police, errr, Chief Bratton and his counterpart Sheriff Lee Baca need to follow the law and stop breaking it. |
