Rep Power: 1400 | I got a pot ticket??? Ok so this is the scenario. I live in the northern most part of san diego. Two cops roll up on me and my comrad while we are happily and peacefully medicating on a street by my house. Im a 4th waiver which means i can be searched without consent whenever a law enforcement officer pleases. To make this long story short when i informed the officer that i had marijuana in the car he asked for my "prescription". I pulled out my reccomendation from my doctor (which is completely valid and up to date) and he asks me "this is all you have?" I tell him "Yes" like its all i need. He then proceeds to tell me that i need a county card and since i dont have that it gives him means to arrest me. He said that just to be a dick cuz he didnt even arrest me.I believe under prosition 215 it allows patients use marijuana for medicinal purposes with a VALID DOCTORS RECCOMENDATION, WHICH I HAD. I have never read anything about HAVING to have a county card! Anyways he ends up letting me go with a pocession of marijuana ticket. Now my question to my fellow WT'ers, I want to fight this case and win, I am tired of being pushed around by cops and them laughing at my reccomendation like theirs a good joke written on it. It's not right and I want to fight! Any info and help would be greatly appreciated! Thanks again!! |

Because i hear often that people or certain counties having trouble with people without a county card, riverside is possibly one of them. Fighting the ticket shouldnt be hard but just getting a county card will be good idea if you plan to medicate in street, as you would before. |

Same thing happened to me, not to worry though, once you get to court you need to show that you are a legal patient under the care of your doctor and the ticket will be dismissed, then you strut right on out of there while everybody else is getting reamed, the only thing you need to work on right now is your courtroom strut! Seriously, don't sweat it. |

The county card stops leo in their tracks, they must let you and your meds go unless you are in violation of the law. The recommendation gives you the same protection as the card, but under the law, you can be asked to explain yourself to a judge if you don't have a country card and with just a rec, leo can "arrest" you, cite you. Technically, when you've been cited, you are "under arrest" from that point forward and until the hearing, read the ticket. Technically, you are under arrest until the case has been dismissed, if it gets dismissed. I always carry my rec and medical records with me so that leo knows I'm for real, they always let me go cuz they know sending *me* to court would be a waste of taxpayers' money! Good luck, be prepared with your medical records for court or be prepared to be found guilty of possession! | |

Get a consultation, the lawyer will tell you what to do, if anything. Sorry, bit if you want to fight any type of ticket the only reliable way to do it is to hire a lawyer. and yeah, invest in the county card. SD county is the wild freaking west, if you have a card they will leave you alone maybe, without it, good luck..... |

No Medical Cannabis I.D. is required by the State.. Its voluntary.. Also County cards fall into this also.. In fact.. vary few Counties are even issuing them.. State law does require that you produce a Doctors recommendation while the police just snub This one document that is legal by state law..... You just need that and a current drivers license to get Meds in a Dispensary legally... But the Police ignore or make fun of your rec and expect you to pull a County ID out... Thats a Joke..... | |

The card is voluntary but the actions leo are supposed to take are mandatory. The card stops them from arresting you and, or confiscating your meds. The rec stops a judge from prosecuting you if you are seriously ill and leo sends you to a judge for a decision. | |

I have taken everything that has been said into consideration and will prepare myself accordingly so i can try yo get myself out of this mess. The only reason why i was so confused was because i have been confronted by cops twice who let me keep my meds and my pipe just by showing them my rec. I just think these cops were having a bad night and wanted to ruin a couple of kids' evening, cuz they were complete assholes the way they were going about it. They were treating me like i had a fuckin pound of heroin in the back, it was insane. Thank god i actually DO use marijuana for my illness, because by providing me medical records i can easily show a judge how mmj has benefited my life. Like i said in the beginning THANK YOU for all your guys' support. Without it i would be COMPLETELY lost. PEACE and LOVE |

What were you thinking? Most people on probation avoid going back to jail like the plague. No one should be jailed for pot. If you have waived, you need an lawyer. Rep Power: 19704 | Re: I got a pot ticket??? its up to your doctor to determine the validity of your needs not a judge with no medical degree. similar reason as to why Dr Bearman fought the law on a similar issue and won. when we have judges or leo who believe they are qualifyed to make medical decisions for you i think we have a big problem. its very unfortunate but some of us may need to be the test cases that get our rights to medicate completely established. my doctor explicetly told me to carry a packed bowl in my top pocket and to medicate as needed,even if this was in the middle of a crosswalk . at some point the ability to drive while on narcotic pain meds has been established for pharma users. if its ok for someone to drive around on oxycotin i think weed should be fine. as long as the user can pass a sobrity test in either case. I go to renew my script in 2 days and will talk with Dr Bearman about this . |
