So I was walking down the street to pick up my daily pack of smokes as usual. So as me and a buddy of mine are returning from the store, on foot mind you. A fucking cop pulls up and looks at us, well as he drove off he suddenly pulled over and waited for us to get to his car. Well as we did we were greeted by this facist fuck and his little rookie partner. So as 30 fucking Mins of my life were fucking wasted I was sent on my way with a nice little ticket from the Burbank police dept. Anyway I told the cop I was a patient showed him my paperwork and the stupid fuxk still took my meds. This is my first time dealing with this and any help or advice would be greatly appriciated.

Dude, that sucks! I've heard of a few patients up in the Visalia area of CA that had gotten busted for meds (like a 60 yr old guy) actually took the cops to court or demanded that they return the plants (or at least the buds) they had confinscated from their house, only to hear something along the lines of, "We aren't going to sit down and sort through a bunch of illegal marijuana to find the quality buds and return them to you, thats just not our job." Not sure where you reside, but maybe you could talk to their superior officer/shift watchman to see what they say after you present THEM with your papers/ID, you might be able to take em to court (if you aint broke like me). If all else fails, give it to the media! I've noticed alot of people turning their un-resolved police problems to the media and getting notice from other people up the same creek. The police have a tendancy to fold when people start protesting their service over something so trivial (to them) as a legit MMJ patient getting pretty much robbed by one of their officers and a rookie ride-along. Contact some support groups like ASA,MPP,etc....
For the meantime, I'll be very careful when in Burbank, and actually will avoid this Nazi-Cop-Force City.!!!!!!

Sounds like they were waiting for you to lightup a cigarette. Burbank is the fascist city that will fine you for smoking a tobacco cigarette anywhere. I don't like cigarettes, but I hate nazis alot more. Burbank city is a POS.

No not at all. I was walking down to the liquor store and I was stopped on the way back. I was not in front of a collective, stupid me forgot to leave my meds at home. And yes Burbank will not allow a collective at all :(. Thank you everyone for all your advice I really appreciate this

Never Presume anything esp MMJ, MMJ Law or LEO!

Well I'd like to say it's a cut and dry your in the clear, however it's not quit that simple. Babyboomer gave you very good advice have you called ASA yet?
They stand up for us and if your meds were taken and your a patient with a valid medical necessity and a valid doctor wrote your recommendation and it's valid and you were not breaking any other local ordinance...etc. you are more than likely going to be ok. Call ASA! Good Luck....

A friend of mine was illegally searched twice (diff cities and pd's same county):
The first time he was given a citation. boo. For the most part illegal search, they said they smelled marijuana but that can/is abused.

The second time it was hella illegal from start to get the hell outta my face. Some legal friends agreed, total wtf to john law. My friend never signed any cit at the scene, but he received it in the mail (he even showed me, no signature). Cit's have a court date but his case was never picked up or anything. Long but funny, funny story (they even took other property of his).

I have not had to go through any of that madness yet but here is something I've learned:

Felix K of GG (as well as three other individual cases from HB) went to State Supreme Court to get back their meds and apparatus's from police confiscations such as yours. In a nutshell, Felix was pulled over with his meds (forgot his license) and was taken to court which was dropped. The court doesn't want to hear these (mmj) cases and passes the case to the appeals court who then cant do much. GG (and HB) extremely anti-pot and mad they lost the case refused to give back meds, so the pd was taken to court to forcibly return the Goods. This case cost GG over $200,000 for 8g of mmj. HaHa! The info that I got was from the OC Register and if you want dates and websites let me know.

Basically talk to legal people, do more homework than necessary, bring your paperwork to court if it goes that far, and remember the worst that is going to happen to you is that you are going to lose your meds; as for the city they lose a bunch of money to file and fight you, tie up the court system (LACo is way overbooked) and ultimately get no where (less than 25.5 g of mj is a fine of $100 and maybe a class (for non mmj patients), source canorml).

So you know you ain't going to folsom, at the same time not a dime will leave your pocket or a day in jail will occur to you, what you did was totally legal and you are helping ALL smokers fight the battle!
