Court Support Needed Thursday For Bryn Anderson And Paul Shaw

Medical cannabis cultivator Bryn Anderson and Paul Shaw will be in court in Pamona on Thursday to defend themselves against alleged probation violations. Please support them and their families during this difficult time:

What: Probation Hearing For Bryn Anderson and Paul Shaw
When: Thursday July 23, 2009
Time: 8:30 AM
Place: Pomona Courthouse South, Department F, 3rd Floor, 400 Civic Center Plaza, Pomona, CA 91766

Bryn and Paul had a medical marijuana grow in Azusa. It was a 100% medical, and they had all the documentation plus dispensary operators prepared to testify in their behalf.

Their superior court judge refused to hear any of it, and the court's justifications for refusing to hear this evidence were so out in left field that the case has gone up on appeal and is now being readied for submission to the California Supreme Court.

Meanwhile, while the appeal was in process, Bryn and Paul were on probation.
When you're on probation, you give up many of your constitutional rights. For instance, there is no warrant requirement to come into your home, probation can come in any time they like, with no notice.

The probation people go out with the LAPD on joint operations. The probation people do home inspections and the LAPD pick up people who have outstanding warrants.

They go early in the morning, usually starting around 5 A.M. Obviously, people who are sound asleep are easier to roust.

This particular morning, probation was looking to inspect Bryn's home environment and the LAPD were picking up a couple other people in the apartment building (unrelated to Bryn and Paul) who had outstanding warrants.

Because Bryn's apartment is on the first floor, the police surrounded the door and the front windows, then all ten of them began simultaneously banging on the windows and shouting. The idea is to wake people up suddenly and so scare and disorient them that they don't dispose of evidence or change anything before they open the door.

Of course, Bryn's dogs are woken up as well, and they begin barking. The police inform Bryn they are going to shoot the dogs. Fortunately Bryn's significant other has a significant brain and was able to calm the police and the dogs.

They do the home inspection and go through the rest of the building, they find the people with outstanding warrants and they find Paul Shaw. They deem Paul and Bryn to be in proximity (one of the things you have to agree to is no contact with the other people indicted with you.)

The same judge who ignored the pertinent state law in their original case, has now denied them bail pending a probation hearing tomorrow, please come out and do court support if you can.

Damn. This *really* *REALLY* sucks.

Bryn's got a brain -- he used his common sense to de-escalate two Nazi like deputies who wanted to beat the crap out of my son while they were wrongfully evicting us from our home for our lawful use of medical marijuana, and for no other reasons. Had Bryn not used his brain, the deputies would have started quite a scene -- my son is a very bad morning person due to his sleep disorder and he is *very* well trained, this would have been ugly. But Bryn talked them down -- they stopped, they looked at the three of us and just de-escalated.

No-doubt, he should not be prosecuted for growing medical marijuana in compliance with the law. But, SHIT-FUCK. He made us all look like assholes for not simply complying with the probation agreement and then filing suit for deprivation of civil rights, harassment, and wrongful taking of his and his patients' meds.

Forgive me...but why did he do this???

If anybody's heading out to the hearing via the 101 and you are passing Thousand Oaks, PM me. I'd like to carpool with you. Though he fucked up, he's a true brother and he deserves our support. We're all human. We've all fucked up at one point or another.

Oh well. It is what it is. In the end, this will bode in his favor. Despite his probation agreement violation, the original charge has no legal basis. Asking a human not to hang with his brother is tantamount to a civil rights violation of the right to free association, wrongful imprisonment after wrongfully prosecuting him and now imprisoning him for associating with his brother -- this is Nazi like oppression, not un-biased adjudication of the law.

The whole community should take the day off and just go to this court house to give him complete support the same way the community should have been at my door when Bryn was and everybody else was ...whatever.

We should send a powerful message to the courts -- enough is enough. President Obama should keep his campaign promises to respect states rights and to stop the harassment and raids on California medical marijuana facilities.

I'm hitting the sheets at midnight and will be ready by 6:00 AM if anybody is heading out that way.

An un-believable travesty of justice here and Bryn shouldn't be allowed to fall through that crack. He's a good guy who has withstood a lot of oppression thus far over medical marijuana, even in my home -- helping total strangers. My son was on probation and the probation officers would brag about how long-term criminals would cycle in and out of probation offices making many more serious violations with no jail time. This is clear cut oppression of an individual via political and fiscal motivations that have nothing to do with the law, simple corruption to continue the oppression of hemp. This must stop now, with Bryn.
