My 2 appeals go to oral argument on May 19, 2009. Benjamin Owens will argue the case.

May 19 at 9:00 a.m.

Where:
Second District Court of Appeal in Los Angeles. The address is 300 S. Spring St.

Okay.

I was injured in Iraq. Diagnosed with PTSD in theatre. They gave me pills and I went back to work.
I crushed my L4-L5 discs, was medivac'd to Baghdad ER.

I got back and started drinking and abusing pills. I got 6 speeding tickets, and crashed my car and motorcycle.

Fed up, tired and confused.

I went to Dr. Eidelman and got a recommendation. He told me to quit smoking tobacco and drinking and taking pills and I did. My life totally changed.

For the first time, while growing my own medicine, I felt a ray of hope. I felt "connected" again.

I got arrested with some herb and my pistol. They didn't charge me for the pistol.

The police did a great many things with a lack of professionalism, and a downright dishonesty. As a Marine Sergeant, I was appalled. As a citizen I was scared. The wielded their authority with no regard for its effects.
They never contacted my doctor. they chopped down our collective garden of 400 plants, only about 3 or 4 pounds, as we grew organic soil sea-of-green.

The police lied on the stand. And it hurt to watch.

The prosecution admitted I was a legitimate patient, but argued that I had "too many" plants for just 1 patient, even though there was testimony and evidence of other patients and the police testified to finding the recommendations which they called "...some medical paperwork of some kind."

They kept pushing me to take the deal. I could get out of jail if I just took the deal. I could see my son be born if I just took the deal.

I didn't get out of jail and I didn't witness my son's birth. I fought my case for 18 months, I spent 11 months incarcerated.

I lost my life's savings, I lost my printing business, I lost EVERYTHING I owned. I lost alot of respect.
They made a criminal out of me even though I grew to specific guidelines as per the CUA and H&S 11362.7.

The police made a careless mistake by cutting down my plants live on the 11 o'clock news without consulting my physician to determine if I was even a patient. there was no turning back.
I was now a homeless convicted felon.

After my family suffered through extremely tough times and my fiancee and my son made huge sacrifices.
My aunt and uncle tapped their retirement to assist me. We stayed in a friend's small studio.

Over 4 years after being diagnosed, I got into a civilian treatment program called The Pathway Home.
Today I still struggle with the ramifications and financial hardships of a convicted drug offender.
I lost my VA benefits for many years and may soon get them back.

I just feel so disgraced, so robbed. I was within legal guidelines, for sure, also having a 420 exemption, as well as multiple patients. And THEY broke the law. That is why I stood my guns. I believed in my heart I was right.

Maybe, just maybe, justice will be served.

Then, maybe, I can have some peace in my life.

i feel your pain and I hope you come through this okay something similar happened to me check out these theads. If I can (need to talk to bosses) i want to show in support I will know soon.

Well, I won. I got a full reversal in the California 2nd Court of Appeals. I am now waiting on the 3-justice panel to issues their opinions. The justices didn't even allow my attorney to speak. They had already decided before court convened. That almost never happens.
I am excited to see the results and hope it will be published and People v. Northcutt will stop some of the illegal and malicious prosecutions by law enforcement.
