Rep Power: 48 | Re: County Formal Probation? The court system does recognize medical recomendations for medical marijuana depending on the circumstances. I was on formal probation and I got a medical recomendation for marijuana before I was officially put on probation. My PO constantly gave me crap about failing all my drug tests for pot and she wouldnt recognize my recomendation from my doctor. She even called my doctor and got into an argument with him over the phone. My doctor tried to tell her she was wrong and she was. I hierd a lawyer from a recomendation that I got out of high times his name is very well know in marijuana cases Bruce Margolin. I went to court to see if I could get off probation, I did everything I was supposed to 80 hours of community service, meeting with a therapist once a week, staying out of trouble, and coming to see my PO every two weeks. The only thing was I failed all my drug tests due to marijuana, however they NEVER found any other substance in my system. I was released and my porbation was terminated becasue the law says! It was a very tiring process and through it all I was scared out of my mind thinking I was going to go to jail if things didnt work out how they were supposed to. You just have to follow all the rules and everything will be fine. BY the way, Advil doesnt show up as Marijuana the drug testing companys that they use for probation are very smart they are RARELY fooled. Be Careful! |

Rep Power: 0 | Re: County Formal Probation? Right on, Greenthumb! Way to stick it to them! You did everything right with respect to the law. Too bad the drug warriors on the other side (DEA, POs, some local cops and courts, etc.) can't respect the very laws they're sworn to uphold; they're our employees, and if they can't follow the rules, they should be fired. They're so brainwashed that the proven benefits of MMJ just can't cut through the last generation of thick propaganda....yet. Nice work exercising and upholding your (and all of our) RIGHTS in the face of government bullies! Since bullies react to deep-seated fears, just what are all those gov't-sanctioned bullies so afraid of anyway??? If real, good people's lives weren't so screwed-up by the drug war, it would be funny that a little plant causes the government's "drug warriors" so much fear, nervousness, and misplaced hate, all while wasting precious tax resources belonging to all citizens, including hundreds of thousands or more of cannabis consumers. |

Rep Power: 19 | one thing i found out is, depending on what condition you have the court system may or may not take medical marijuana reccomendations into consideration. i know my condition isnt as severe as other MMJ patients, but i still have a reccomendation and marijuana DOES in fact help my condition. (just for the record) Recently I have been in quite a bind with my finances and couldn't afford to purchase meds on a regular basis, allowing my condition to dramatically decrease my health. I.E.: i've unintentionally lost aprox. 20lbs since august and havent slept NEARLY as much as a growing boy needs (9-10 hrs/nite). If you've talked to me in the shoutbox all throughout the nite like quite a few members have, then you'll know I rarely sleep. ANYWAYS....... back to the subject. I was convicted of possesion of less than 28.5 grams of marijuana and am being forced to pay $310.00 to the local court. Yea, it's only 300 dollars, but I'm a patient. A patient who could barely afford his medicine in the first place. I just think it's really unfair to not be compassionate to a patient just because he/she doesn't have a "serious illness". |

Rep Power: 0 | Yeah I have gotten a felony for possesion with intent to sell of a pound of mj and possesion of mushrooms. I was told by my house arrest case officer that I was allowed to continue in medication and that they were going to respect my card, then I get pulled over the other day and they took my less than an 8th and steam roller and wrote me a ticket for possesion in vehicle, it wasn't CHP it was just a Temecula pd on a bike. They called a squad car, searched my truck, took my peice as well as a broken JBD that I was gonna have fixed but wasn't able to smoke out of it and put it in the squad car, but the bike cop (lavigne) took my herb and put it in the side of his bike. They believed that I was a patient and still took my medication and I wasn't high or smoking at all that day. The officer told me that I couldn't have it in my car as well as that I shouldn't use it cuz it will kill my brain cells and I responded with a rebuttle after he reccomended I stick with the advil and regular perscriptions, but the base reason why I have my rec. is for alternative medication because I have a torn ACL, no medicare, and haven't been able to get the money together for surgery (15,000). I called my PO and she said that I was gonna get in jail again from what the case officer told me and that in no way am I allowed to keep medicating and that they will not respect my reccomendation. When I go for the ticket on February 27th I am going to fight this with the help of my friends from C.B.O.T.H., ASA, MPP, MAPP, and NORML. Some of my fellow medical patients and MMJ activist friends are going to start a rally protest out front of the court room during my hearing. If you would like to support let either me or Von Kush from this site know. We will prevail. |
