Rep Power: 3929 | Re: arrested 4 hash Umm if you have your hash in a bag that they sealed for you and the cop finds the bag, well then he is not allowed to legally open it. There are also laws to protecting patients against concentrates, but concentrates are considered a felony in any amounts. If your buddy is a patient he should be able to get out of any trouble he has, unless you guys were smoking or some dumb shit |

Rep Power: 3664 | Re: arrested 4 hash Sounds like your buddy was stopped for something else and the charges escalated because of it. I would venture to guess someone was smoking herbs in the car (not smart). A med rec does not give people the right to smoke pot everywhere and get away with it, why don't people get that? |

Rep Power: 243 | Re: arrested 4 hash all cops try to do is trick you. don't fall into the trap. travel safely: do not smoke and drive. If your travel with cannabis, make sure your vehicle is up to code and your cannabis is concealed, preferably in your trunk. be prepared: carry your rec and state issued id card at all times, but do not present it to law enforcement unless accused of a marijuana related crime. be discreet: try not to smoke where others can see you and never leave cannabis items in plain view first don't consent to a search example. cop - "do you mind if i look in your purse, bag, home, or car?" you - "i do not consent to a search." cop - "why not? are you hiding something?" you - " i believe in my constitutional right to privacy, and i do not consent a search" i got this off of my American's for safe access card http://www.safeaccessnow.org/article.php?id=690 hopes this helps you all. |

Rep Power: 3604 | Re: arrested 4 hash This is true, it just depends on the officer and how you act to them. If you act like a dickhead they will find ANY reason to bust your ass and pull one over on you so the best thing you can do is cooperate and not be a smart ass. I have got out of encounters with the police without even receiving a ticket because I was polite, respectful, and cooperative. I even had a cop that found my roommates seeds and he gave them back to him and everything. And as someone said before, don't mention you're a patient unless he suspects marijuana or something, then it's best to let them know right away so they don't think you're hiding anything or doing anything really illegal or whatever. |

Rep Power: 2827 | Re: arrested 4 hash Never inform the police of your patient status unless absolutely necessary ... which usually occurs AFTER they discover mmj or a concentrate in your car. I would also say never let the police search your car period, but if they have probable cause you are pretty much stuck with a search. I don't know the details on why your friend's car was searched, but if police have probable cause there is no reason to put up a fight ... because at that point you look like you are hiding something. If you continue to refuse a search then you will be forced to wait until they obtain a search warrant for your car, bring drug dogs, and at that point you wasted a few hours of the cops time ... and they will not be lenient on the police report. If you are polite, cooperative, and respectful the police will not be assholes.... most of the time. I've encountered the typical "old high school bully" cop who has nothing better to do than be an asshole plenty of times. Having a card does not give us the right to transport concentrated cannabis, because as everyone said it is still illegal. There are two possibilities for your friend... He will either have the charges dismissed, or he will receive a misdemeanor for being in possession of concentrated cannabis. I would say that the prior will MOST likely happen due to his patient status (I would say a 90% chance), but you never know what DA or judge you will get. I would suggest having your friend get a good lawyer, and not going with a Public "Pretender" (Defender) who won't remember their name... I'm not saying they are all bad, but from personal experience most of their case loads are WAY too high to be able to give 100% to each of their cases. Our system is bullshit, but it's the only one we have ... so we have to deal with it. For your friend's sake I hope it wasn't in the OC, because going through the loop in OC main jail is fucking bullshit. For every 5 minutes of work that they do, they take a 90 minute break... and about 75% of the guards there are assholes who try to pick fights with detainees. Quote:
Remember ... Cops are TRAINED in lines of questioning to make people slip. Try to never lie to a cop, and just keep your answers in line with your rights.... If you DO lie, which I don't suggest, just make sure that you DO NOT SLIP... Once you slip the police officer will automatically assume that you are hiding something. They deal with criminals on a daily basis, so it is hard for them to be draw the line between criminal and citizen, especially when that citizen is a patient. Rep Power: 3595 | Re: arrested 4 hash the last members are correct, all our hash is water or iso. alcohol made which is 100% legal and safe for you. The cops are mainly after the butane extracted stuff simply because of the "cut" used as well as all the "problems" theyre having with bad extracts. Hope your buddy gets everything handled |

Rep Power: 2309 | Re: arrested 4 hash you will probably deffinetly get off, linder is right, hash is protected but it is a real pain in the butt to get arrested. i bailed out my friend who is really dumb and straight up showed the cop his hash when he got pulled over thinking that it was ok because he was a valid patient. the cop asked if he had anything illegal and he said "i have hash but i also have this" (0.2 gram) and showed him his rec. the cop said he had never heard of recomendation for marijuana and that hash was a felony. his bail was $3000 which meant that i had to loan him 300 for the bonds lady he never got back. then there was the impound fee...to bad his car got impounded on a friday before a three day weekend. it was around $400. i paid the bail within an hour or two but he was in jail for 12 hours. that is where they get you, 12 hours in jail and $700 out of pocket. don't smoke in your car, a dui costs like $10,000 for alchohol and i think they can do the same thing for herb, dont consent to any searches because all it takes is a jerk cop to seriously ruin your day. good luck getting money for your anguish and expenses, it will probably cost you more than you get out of it, it would be great if someone won a large amount for wrongful imprisonment, that would make the cops that "havent heard of prop 215" think twice. |
