Exclamation Charles Lynch Sentencing on October 20th, not October 6th

ASA's chief counsel, Joe Elford, just got off the phone with Charles Lynch's attorney. He confirmed that Lynch's sentencing is NOT on October 6th and is instead scheduled for October 20th. However, it is VERY likely that the sentencing hearing will be pushed back to a future date, possibly in early 2009.

The hearing on the 6th is the motion for a new trial hearing. That hearing is likely to be held on the 6th so it might make sense to still hold a protest that day, but again, it won't be the sentencing hearing.

I think it makes sense to plan some sort of action before sentencing, since it likely won't happen for many months.

Re: Charles Lynch Sentencing on October 20th, not October 6th

Here's what I posted somewhere else, thinking his trial was still in progress:

Public Faces Medical Marijuana Scam
(This was a discussion spurred by an Article in The San Bernardino Sun by some DEA flunky.)

Quote:
I'm wondering if Lynch might be the Lynch-pin for the feds intrusion into the states. I hope their lawyers are very busy this weekend.

Here is my thinking: California Court of Appeals declares 'medicinal use' is EXEMPT from the CSA.

Lynch bases his defense on that, and it goes to the Supreme Court with California vs. U.S....

With the weight of the State of California on OUR side.

Here is the L.A. Times story, with Lynch surrounded by the chamber of commerce cutting the ribbon for his store: Conflicting marijuana laws take stage in trial (Last time I looked at this story it had a large picture of Lynch cutting the ribbon to his store surrounded by The San Louis Obispo Chamber of Commerce. What happened to that?)

And his lawyers should be able to argue that THIS gives them the right to argue MEDICAL in federal court!
It seems to me if you're moving for a retrial all this is still possible?

We're working on the details. I were thinking of having SLO patients, former employees, supporters protest OUTSIDE the SLO Sheriff's office on the same day as our LA protest. Stay tuned. We'll need someone up there to help organize.

yes please keep us updated on the protest because even though I live in Nor Cal I will be making a trip down to L.A. to show my support for Mr. Lynch and all the good he tried to spread, and all the shit our government has laid upon him.
