LA-ASA Meeting 1:00 PM on Sat, Sept. 22

Hello, ASA Members and Friends.

We are kicking our California campaign into high gear this Fall, and we need your help to make it happen! I hope you will all make a special effort to attend the LA-ASA meeting this coming Saturday, September 22. This will be the primary planning meeting for the big October 11 mobilization to the Governor’s office in LA. You can read about the campaign and mobilization at http://www.AmericansForSafeAccess.org/StandUp We need as many people as possible to come on Saturday and help promote the event in advance.

We will also be checking in on the recently-effective LA moratorium, DEA raids, threats against landlords, and local regulations. There is a lot going on! Here is the info for Saturday:

so where were you yesterday ? anything happened important during the rains ?

seems that not a single wter showed up for la asa meeting and that just plain pisses me off . theres no reason really for not attending in this time of need. just because there was no raids in la doesnt mean that actions are not needed by us in the movement.

WHAT DOES IT TAKE TO MAKE PPL REALIZE THAT THEY ARE NEEDED TO ATTEND THIS MEETINGS AND OTHER FUNCTIONS ?????

cant stay in cyber world and act like your doing something, you need to actually participate.

i do understand about other things happening, too sick leave the home, work and other IMPORTANT things but lack of transportation or didnt know about it, was afraid. forgot are all BULLSH*T to me. let's the too sick to leave home ppl do the cyber world workings and the rest of us to be in the streets doing what has to be done.

i am asking as a patient and activist that ALL co-ops within the LA area to be closed during any protest events/rallies/and important gatherings like city hall meetings. i also ask them to send everyone who works for them to the event that maybe happening.

i say to other patient and caregivers boycott co-ops who stay open during rallies, ones who do nothing to help the movement. i seeing that co-ops are going underground and thats not good for patients and real bad for our movement. it is like taking several steps back and hiding like your doing something wrong. STAND UP AND FIGHT FOR OUR RIGHTS !!

ASA is looking for street theater actors

ppl to help make artistic things

will be a meeting for those who liked to help in these areas as well as anybody else who liked to give a hand

not looking for this to be a protest with chating but a day of asking arnie to come out and support us so any ideas in doing this with street theater and costumes and such please contact LA asa.

Asset Forfeiture and Medical Marijuana

What is asset forfeiture?
Asset forfeiture refers to a civil or criminal action in which the state or federal government confiscates assets that were acquired with proceeds of a criminal act or were used to commit a criminal act. Congress and state legislatures created asset forfeiture laws to target large-scale narcotics trafficking operations, but they are most often used against small-scale offenders. Asset forfeiture laws generate a tremendous financial windfall for law enforcement agencies, and widespread abuse of these statues led to federal reform measures in 2000.

What does this have to do with medical marijuana and my property?
Medical marijuana is legal in twelve states, but federal law still prohibits its use under any circumstances. Until federal law changes, people who use or provide medical cannabis are at risk of federal prosecution - even if their conduct is legal under state law and sanctioned by local government. The Drug Enforcement Administration (DEA) recently sent notices to property owners in the Los Angeles area informing the owners that they may face criminal prosecution or asset forfeiture for knowingly renting their property to a medical cannabis facility. The notices do not indicate that any property owner is being charged with a crime or is now subject to asset forfeiture.

Is this legal?
Yes. Although asset forfeiture charges are controversial, they have been upheld in court. The US Attorney's office can file criminal charges or initiate asset forfeiture charges if it can prove that a landlord knew that the actions of the tenant were illegal and did not take reasonable measures to stop those actions. Only the US Attorney can file these charges. The DEA notices do not indicate that any charges have been filed.

Why is this happening now?
The DEA has been active in trying to close and intimidate medical marijuana facilities in states where it is legal. Until now, the DEA's primary tool to do this was to raid a handful of facilities and confiscate the medical marijuana inside. Few of these raids resulted in criminal prosecutions, and most raided facilities simply reopened. Sending notices to landlords is a new tactic designed to intimidate property owners into evicting the tenants without the cost and inevitable public backlash of raiding facilities. It is important to note that these notices and related federal activity coincide with an important vote in Congress on funding for anti-medical marijuana raids.

Will the US Attorney prosecute property owners?
It is unclear. The US Attorney's office has the authority to prosecute property owners, but there is no indication as to whether or not they intend to do so. It is important to remember that the notices recently sent to landlords are from the DEA and give no indication whatsoever of the US Attorney's intentions.

What should I do if I receive a notice?
Property owners who receive a notice from the DEA have not been charged with a crime. Nevertheless, you may wish to consult with your attorney or an asset forfeiture specialist about your rights and responsibilities under the law. Lawyers will likely advise you not to make any statement to the DEA indicating that you know or agree that your tenant is engaged in illegal activity. Doing so may mean giving up important rights in the unlikely event you are later charged. There is no need to act immediately if you receive a notice. This situation will probably unfold over many months. Take time to consider the issue, talk with the tenant, and make up your mind. Always remember that the DEA is trying to intimidate and manipulate you into evicting the tenant as soon as possible. You do not have to succumb to this pressure without undue consideration of your financial interest in maintaining the lease and your rights as a property owner.

What if I was unaware of my tenant's actions?
Federal asset forfeiture laws provide for an "innocent owner" defense for property owners who were unaware of the illegal activity and subsequently take reasonable steps to stop the activity. In some instances, this may involve initiating eviction procedures or requiring tenants to refrain from violating the law. You should discuss how the innocent owner defense applies to you with your lawyer or asset forfeiture specialist.

we talked about oc and its issues of recent bans and other issues. this is cause a memeber of the oc asa (reg pateint) attends both meetings in helping keeping ppl informed.

we talk about the victory of asa in dc with a law that would have killed our movement that wasnt allowed to be told public so that they could take care of it. we can thank the aids community for telling us about it and helping asa squash it.

now there starting the regs for co-ops which could take awhile since it involves all these different reps form different depts and possible committees. any counsellor memebers can add a committee if it pertains to the issue at hand.

simply put we tell them what we want and they do the same and we then debate over paper what should be and when we all agree then we can move forward.

Thanks, FREEkaya! The street theater sounds really cool! It'll make for great pictures. Also, it will be wonderful practice for the Doo Dah Parade in November.

I live in North Hollywood, where we have lots of little theaters. How about I make a poster designed to appeal to actors and put them up at the theaters?

Also, I have friends that work on the studio lots, and I've given them the "standup" posters on 8by10 to put up on the stages (those people have PLENTY of time to read bulletin boards!)

PS Sorry ASA is losing Chris... hope he's running for office or something!
