Tho there are no mmj dispansarys operateing in culver city , yet the city thinks its time to adopt a ordinance on issuing business tax license to "any unlawfull activity" ... guess all the serisouly ill patients of culver city will have to drive a miles for there meds.

The council will review this decision before it goes to affect heres a link to council meeting (the topic is disscused 01:40:00) , maybe the patients of culver city can stand up and go to the meeting to voice there concern....just a thought lol

There is multiple caregivers within culver city limits.

kinda funny i just looked and even the co-op with Culver City in it's name is located in Los Angeles (although it is adjacent to CC...)

I grew up in CC and I was pretty sure that the co-op on Venice is not within Culver City limits... I also checked, and it's not..... CC is a really conservative little town.....

yes it is - i lived in mar vista for a long time and spent a lot of time in CC. now i live in ultra conservative Burbank... yaaay, lucky spacey!

About 3 years ago I went to cc city council meeting and asked why there was a Ban on mmj dispensaries in CC......I have never been escorted out of any place so fast in my life.......the assist city attorney almost fell out of her chair trying
to get up to come talk to me.....Culver City is a "no man's land" when it comes to MMJ...!

how would that work if mmj is state legal? wouldnt the coop then be lawful.and isnt all illegal activitly already illegal what will this really add

Zoning issues are regulated at the city and county level. Though localities cannot ban medical cannabis, the growing of medical cannabis, or private patient coops, it is unclear if they have the right to ban storefront dispensaries. All legal under the state law, but as for federal law its illegal for the sale of canabis and culver city is going to use our local tax to enforce a federal law .

ASA- isnt there somthing in the California constitution where it gives instructions to the local state gov where there is a situation between fed and state laws , ?

Unfortunately, it's a bit more complex than that. While ASA believes firmly that state law allows for medical cannabis dispensaries, state law does not explicitly tell local governments that they have to allow dispensaries to operate in their localities.

And in terms of law enforcement, it gets even trickier because some of them are cross-deputized (meaning they're state and federal law enforcement officers at the same time), and even if they're not, they can simply hand cases over to the feds.

Does anyone know of a precedent where a city already has retail dispensaries, changed the city zoning, and forced the dispensaries out of business? If this has happened (I think Oakland may have done this and then allowed some back) does anyone know if a legal challenge has been successful?

The ban is in violation of state law! seems to be allot of police & public officials that think they can stand in the way of progress! Lots of cities in California are trying to deny patients their rights culver city is just one of them! Things are changing though & it Won't be long before this prohibition is officially over!!!
