Rep Power: 370 | ASA Victory: The End of Medical Cannabis Seizures in California ASA Victory: The End of Medical Cannabis Seizures in California Court rules that police must enforce state, not federal law Dear ASA supporter, Yesterday, a California Appeals Court ruled that “it is not the job of the local police to enforce the federal drug laws.” Ending years of dispute, the court ruled in favor of Felix Kha, a medical marijuana patient seeking the return of his medical marijuana that was seized by police. “It should now be abundantly clear to law enforcement across the state that it is not acceptable to seize the medicine of seriously ill patients,” said Joe Elford, who represented Kha as Chief Counsel with Americans for Safe Access (ASA). Yesterday’s victory marks the culmination of two years of litigation led by ASA. This important decision would not have been possible without the generous contributions of ASA supporters. According to reports received by ASA, rampant seizure of medical marijuana from qualified patients and primary caregivers has taken place in 53 of California's 58 counties. As of yesterday, California law enforcement will be “fulfilling their more traditional duty to administer the laws of this state,” according to the court’s ruling. A step in the right direction yes, but this could of been addressed a long time ago by suing the State to comply with their own laws per the California Constitution and Prop. 215/SB420. We need more education to the people on how the legal system actually works and if you think the local PD are not going to take your meds still, I have a bridge for sale. Until the State of California is forced to stand up to the Feds like they are supposed to nothing is going to change, especially Federal Law, ask any lawyer. I am not being pessimistic, it is just reality. I am stoked for us and this guy but how many other people will have to go to jail or die before something is done. |

If the lawyer represents a cause then all of your warnning bells should be going off in your head. If they have a book on the subject; just walk away. Many times these special causes attornys will just use you up to further their own agenda. However, if they take your case for free, and have a track record of doing this for others, then their probally legit. I will say this about ASA though, at least they keep us informed about local political events and court challenges. They also show up to represent and defend mmj at alot of city, county, and state hearings when it comes to mmj bans on cannabis or dispencary's. However, acorrding to Orange County Life and Times, that aired "Drug Wars", on PBS Don Duncan owns two dispencary's. Here is where I become suspious of their motavations, sometimes though, nesscity drives us to be hero's, for a just cause. |

I praise ASA for some of their work as they have many great people working for them who really do care about patients and their rights. |
