The Superior Court Judge would not allow me to put on a retaliatory eviction case despite substantial evidence to prove my claim!

The court system is badly corrupt and you can expect nothing but continued oppression and harassment unless either the City Attorney, District Attorney, or the State Attorney General steps in to protect our rights. I will be presenting my case to all those offices tomorrow and the next day, it ain't over yet! I'll keep you posted!

I have witnessed corruption in courts before and in the news and even in custody and juvenile cases, but wow! I just saw it first hand, we're talking a complete deprivation of civil rights!

Kind of far for me. I am in Huntington Beach I wish I was closer.

Oh I had a charge against me over an oz. in my car I had photos showing serial entrapment by the paramount LA sheriffs who actually physically removed the evidence after I took photos of trees in front of stop signs in a residential area where they were routinely using as a entrapment spot and the sheriffs changed the arrest report I hired the most expensive high profile attorney and got shafted like a jail house bitch after spending over a year at compton superior. i feel for ya br'er Eazy. Excellent point. This is exactly the foundation of my case, massive fraud!

I haven't looked into the statute of limitations on fraud, I thought there was a statute stating that you have an amount of time from the time you actually discover the fraud. I'll look into that later and post an up-date!

...when I was a child, I was given a vaccination for whopping cough that causes my throat to lock when I sleep! The mainstream diagnosis is OSA (obstructive sleep apnea). When I "obstruct", this means I cannot breath in oxygen and I cannot breath out co2 when I am sleeping and the obstructions occur. The obstruction is the muscle in my throat collapsing, but in my case, to the point where it goes shut. This happens, check this out, an average of 47 times per hour. I lived 44 years being misdiagnosed. Finally, in 2004, after a doctor thought my son might have a sleep disorder, but we failed to find a place to treat him due to having only Medi-Cal insurance while I was in college, I did research and discovered the symptoms I had were identical to obstructive sleep apena. So, as an adult medical patient, I was able to demand a sleep study after being refused and got it! I went in for a series of sleep studies and the diagnosis was distinct! The doctors started me on pharmaceuticals before starting respiratory therapies, and I had a bad, bad reaction to the pharmaceuticals. After further denials, I persisted and was able to get the respiratory equipment and what I got was old technology and it failed. Tried a newer technology (they have to approve it now, it's a disability), it failed. Tried another, it worked better but I could not fall asleep with the pharmaceuticals and the pharmaceuticals were making me deathly ill. As a last resort and having no other option, my son suggested I try medical marijuana. After months of research and having voted for Prop. 215 on November 5th, 1996, I discovered that marijuana is a medicine with known success in treating obstructive sleep apnea. I saw a legitimate doctor who prescribes medical marijuana. The first night I tried the meds -- WOW, instant sleep, instant. I smoked a joint and ate an edible and the joint got me hungry. I ate. About an hour later I started feeling real relaxed. I don't remember falling asleep and woke up feeling refreshed the next day. Instant relief. Then, I discovered the machine I was using still wasn't work well. So I got the newest computerized respiratory device available and it works! Between the medical marijuana and the computerized respiratory device, I can sleep. I lost 52 lbs. of fat that would not come off before I started medical marijuana. I have a injuries. The medical marijuana slowly but surely resolved the pain of these injuries.

Long story short, ...my son, my precious beautiful son...he had the same bad reaction to the whooping cough vaccination, he's got obstructive sleep apnea too, his doctor was right! But, his throat muscle don't fully collapse constantly and his obstructions are not real bad, yet. The medical marijuana improved his sleep dramatically. Before he got the treatment, he was sleep deprived, got in trouble, was on probation, probation approved his use of medical marijuana -- he got off of probation, another mmj success story!

But, that's not the issue people! The issue is; I made complaints against my landlord, a doctor who is in full knowledge of my medical conditions, for his failure to do repairs, maintenance, and supervise his building properly. When we asked our landlord to fix a broken and noisy floor and, or to move us to the apartment above ours since it was vacant and to get away from the noise due to my medical conditions, instead of reasonably accommodating me due to my medical conditions, which is California law, he decided not to repair the floor and to move known noisy nuisance tenants into the apartment to cause me to move because he could not evict me, which is in violation of California law. After almost a year of complaints and sleep deprivation, I fainted due to sleep deprivation from the noisy floor and noisy tenants. I suffered a concussion, complex laceration to my chin, chipped teeth, a cracked tooth, brain damage or post-concussion syndrome otherwise know as great bodily injury, pretty bad, I had a near death experience when I was knocked out, before my son came home and found me and woke me up out of Heaven! I guess it wasn't my time to go! Long story short, while I was in the hospital getting emergency treatment the night I fainted, the manager called my voice mail on behalf of the owner and promised the next available upstairs apartment. But, instead of giving us the apartment that suddenly became available, he tried to retaliate and evict us instead. But, he had no case and could not evict us. I filed a complaint with the state. Then, he reneged and refused to rent us an upstairs apartment and left me in this torturous noise hole till now. But, that's not the end of his evil retaliation! When we still would not leave and he could not evict us, the next set of shill tenants wrote a fraudulent letter to HUD about our consumption of medical marijuana as did the landlord and his attorneys write fraudulent letters to HUD, and then HUD committed acts of fraud and terminated my voucher and now...the landlord gets to evict me shortly if the City Attorney, the District Attorney, the State Attorney General, and or the US Attorney don't step-in and uphold Obama's promises. FYI, they terminated my voucher the day Obama got elected!!!

Also...the entire mmj community will need to get behind me within the next 5-days to video tape and document exactly what I am going through, this is the perfect opportunity for us to move the rights of medical marijuana *patients* forward by documenting these violations of our civil rights. Without your support, we will lose. With your support, we will win!

The state trial just took place for discrimination, but they could not act fast enough due to their limited budget, so the state judge can't rule until August to protect me due to their rules. However, their trial, me as witness, I got all the evidence I needed to prosecute my landlord and his attorneys and HUD!

The low-down: A landlord who is a doctor nearly killed me to cause me to move and when he could not evict me for anything else, he engaged in a conspiracy with his attorneys, his managers, his shill tenants, and then HUD and now what appears to be a "civil" court to cause me to become homeless in retaliation of my lawful complaints against him, but they had to conspire and use medical marijuana rights violations to do this evil act instead. Under the Data Quality ACT and HUD's own data quality guidelines, they cannot enforce a federal law that has no factual basis, Obama has already agreed with these points -- now it's time for Obama to fulfill his campaign promises that are now "American Policy".

..I now know what it's like to be oppressed, bad.

Intentional negligence, mental anguish, nuisance, infliction of emotional distress, fraud, slander, etc...... I am not a legal advisor...lol.

The state just prosecuted the landlord and I was the witness. In this state, you can either start a civil action or allow the state to prosecute a case if the case involves state and civil rights, which my case does! At the hearing, not only did the prosecutor successfully prosecute the case, but the depositions and the trial yielded transcripts where my case was proven as the doctor lied on a few issues, he changed his story on a few others, and in his own words, he did not treat me as he claims he does other tenants, there's more. The big issue was; he as a doctor could not give a reasonable excuse for not moving me away from the untenable conditions as a reasonable accommodation, and the BIGGER issue, he facilitated illegal drug sales and drug use from one apartment with much police contact and incidents without ever trying to evict them, plus, he routinely accommodates other tenants who consume mmj! I did not have $40,000.00 to pay a private attorney to do this, I am so lucky the state stepped in!

Today, the superior court judge was obligated by law to allow me to assert a retaliatory defense but he refused to do so despite all witnesses and evidence being present but for one witness who was 12 miles away with no excuse not to show up for 15 minutes of court time a few hours after putting my case on! The HUD program director just needed to answer a few questions that would have landed him in court, in some states...jail!

I am going to fight the eviction by any means, including what I feared, having a deputy remove me from my home because I smoke medical marijuana successfully and my landlord attempted to murder me to cause me to move because I complained about his slumlord tactics well before he retaliated against me, when that didn't work, he conspired to cripple me financially by making false statements to HUD to get my voucher taken away, which they do not do in many other family's cases, just this one, *medical marijuana*, somebody who stood up for their life, their family, their rights!

Oppression.

If I can help it, my landlord will go to jail and he will have his medical license pulled and HUD will be sued because by law, they are supposed to pay rent during any proceeding, which would have negated this proceeding -- I've seen a lawyer. I'll be seeking private lawyers now because I have enough evidence to seek criminal charges and sue him and HUD for damages, regardless of the eviction, as well as the other charges the state just prosecuted for, they don't go away, this is just more evidence to prove he retaliated and I still have time to intervene in this matter in the state case long before they rule in August!!!

Card and am doing nothing "illegal" by State Law . . . he was surprized and thought he could evict me). Long story short, I went to Bet Tzedec on Fairfax and after 3 months, I can stay! However, the RM got fired (!!!), for doing various violations at this building! Karma. Get in touch with Bet Tzedec!!! =Judy= Oh! Check your lease for a "drug-free" clause, too!!!

Yes, I read your posts in the past. I will contact them. I wanted to see how your case panned out and I needed to gather more evidence, which I got now! So, tomorrow, I'll give them a call.

If you can, I need to know how HUD handled the situation so I can ask for equal protection under the law, if you got the reasonable accommodation for mmj, so should we and we don't grow, we just consume responsibly!
