Both you and the cops can do whatever you want whenever you want. The difference is that there are rarely any consequences for the cops when they willfully make mistakes. Just remember that there are lots of cops who don't like marijuana in any context. They will make it their business to give any user, medical or not, a hard time. Their rationale is to bust us all and let the courts and the DMV decide what to do with you.
